Tod M. Melgar is a partner in the firm’s Intellectual Property practice team with more than two decades of experience helping clients protect and enforce their most valuable innovations and brands. He represents companies of all sizes in patent, trademark, copyright, and trade secret disputes across U.S. district courts, appellate courts, and before the International Trade Commission (ITC).
Tod is a skilled trial lawyer and strategist who has achieved successful outcomes through early settlements, mediation, dispositive motions, and trials. He also has deep experience in proceedings before the Patent Trial and Appeal Board (PTAB), including inter partes review (IPR), reexaminations, and appeals, and regularly represents clients in fast-paced Section 337 investigations at the ITC.
In addition to his litigation practice, Tod counsels clients on building and strengthening their intellectual property portfolios, managing global trademark and patent strategies, and negotiating a wide range of technology and IP-related agreements, including SaaS and software development licenses. His guidance is informed by more than 20 years as a registered patent attorney and his earlier experience as a Patent Examiner at the U.S. Patent and Trademark Office.
With degrees in mechanical, aerospace, and biomedical engineering, Tod brings strong technical insight to his work and has advised clients across a wide array of industries as diverse as semiconductors, electronics and software, medical devices, telecommunications, automotive, consumer products, and fashion.
