Lippes Mathias Defends Village of Fredonia in Article 78 Challenge to Water System Improvement Project

Lippes Mathias LLP is proud to share news of its successful defense of the Village of Fredonia in an Article 78 proceeding in Chautauqua County Supreme Court, securing a ruling that preserves the village's Sept. 10 resolution authorizing the Fredonia Water System Improvement Project. 

Justice Grace Hanlon denied the petitioners' request to annul the resolution, ruling against all claims. Filed in October, the lawsuit alleged the resolution failed to comply with the State Environmental Quality Review Act (SEQRA), General Municipal Law, and Fredonia's own zoning code. The resolution, which includes a negative declaration under SEQRA, authorized various steps by the village to decommission the elements of its current water system and pursue interconnection with the North Chautauqua County Water District.
