Dariush Keyhani, recently published "Bulova Wrongly Decided: A Case Against Extraterritoriality of Trademark Law" in the new issue of the Chicago-Kent Journal of Intellectual Property. This article looks at how U.S. trademark law has been interpreted by the U.S. Supreme Court to have extraterritorial effects and argues how this interpretation is in tension with existing international intellectual property law frameworks that provide appropriate protections for the legitimate interests of U.S. trademark holders.
