Lippes Mathias Partner Ian A. Shavitz to Present on Environmental and Solid Waste Issues at ABA Forum on Construction Law Regional Meeting

Ian A. Shavitz, partner and leader of the environment & energy practice team at Lippes Mathias, will be a featured speaker at the American Bar Association Forum on Construction Law’s 2024 Regional Meeting in Boston on December 5. Shavitz’s presentation, part of the solid waste segment, will address environmental and solid waste challenges that arise in construction projects, with a focus on navigating federal regulations and their implications for site management and contractor liability. 

The solid waste segment will examine the impact of federal statutes such as the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) on contract drafting and how to manage environmental issues encountered on-site. Topics will include addressing environmental disturbances during construction, which can expand liability beyond the project owner, and reliance on accurate site information for existing conditions to support delay claims. Additionally, Shavitz will discuss the role of specialty trade contractors in delegated design and the legal remedies available to secure payment for their work. 

This session is part of a larger program designed to enhance the knowledge of construction lawyers and industry professionals on horizontal construction projects, including transportation infrastructure, water and wastewater systems, and environmental remediation. Attendees will gain practical strategies for managing risks, ensuring compliance, and delivering effective counsel for clients in the evolving infrastructure landscape.
