Kevin’s professional experience spans both the private sector and state government. His background in commercial and governmental legal matters, complex contracts, business and class action litigation, administrative hearings, and data privacy have combined to provide a well-balanced professional career. His practice includes representing clients in litigation, arbitration, and mediation, with experience in all phases of dispute resolution—from early claim preservation through trial. 

A significant portion of Kevin’s work is dedicated to the construction industry and public sector compliance. He regularly drafts and negotiates construction contracts, service level agreements, and advises clients on procurement regulations, D/M/WBE and SDVOB compliance, wage and employment matters, bonding, indemnity, and other liability matters. 

Kevin has served as outside general counsel to several closely held corporations and a global designer and manufacturer of LED display technology. In these roles, he has advised on legal risk and compliance, negotiated and managed vendor contracts, non-disclosure and non-compete agreements, and master service agreements. He has also represented both employers and employees in federal, state, and local courts, including appearances before the New York State Court of Appeals, the Appellate Divisions, and the U.S. Court of Appeals for the Second Circuit. 

Previously, Kevin served as Legal Counsel to a New York State BOCES where he advised executives on legal matters, negotiated and reviewed contracts and RFPs, supported the Human Resources department, conducted employment and student-related investigations, and served as a legal advisor on FOIL matters and Article 78 proceedings. He also acted as Hearing Officer for student disciplinary hearings and advised on test integrity investigations for component school districts. 

Kevin’s public service includes several high-level appointments within New York State government and the Governor’s Office. As Deputy Counsel and Special Counsel at the Office of Temporary and Disability Assistance (OTDA), he led legal risk assessments, supervised the Information Security and Technology legal team, and served as the agency’s litigation strategist for major class actions. He also played a key role in developing a statewide system for monitoring ethics, risk, and compliance, and collaborated with other agencies to strengthen internal controls. 

As OTDA’s Director of Litigation, Kevin briefed the Governor’s Counsel’s Office and executive leadership on material litigation issues, coordinated litigation strategy with the Attorney General’s Office, and managed overall litigation risk. Earlier in his career, he served as an Assistant Attorney General in the Litigation Bureau, defending the State of New York and its agencies in matters involving constitutional torts, civil rights, employment law, and administrative reviews.

Representative Matters

  • Served as chief litigation strategist for numerous class action lawsuits, which involved working with agency staff, executives, and high-level government officials to negotiate fair and meaningful settlements of the following sample matters: 
    • A class action lawsuit that alleged that New York City public assistance recipients were unlawfully sanctioned without proper notice or due process during the period of 2007 and 2015. 
    • A class action lawsuit that alleged that blind and visually impaired New York City residents who were applying for federal and state assistance benefits were denied application materials in accessible formats. 
    • A class action lawsuit that alleged that the State of New York and New York City failed to accommodate disabilities in accessing emergency assistance during Hurricane Sandy.  
    • A class action lawsuit that alleged that the State of New York failed to provide adequate and timely written notice to able-bodied adults without dependents who were subject to work requirements before terminating their benefits. 
  • Successively defended the State of New York, its agencies, and other municipalities in state Article 78 proceedings, federal civil rights litigation, and other litigation matters affecting agency missions 
  • Served on the legal team that successfully litigated a birth-injury case that resulted in a $43.5 million verdict in favor of the client  
  • Negotiated and/or litigated through trial dozens of civil matters including commercial litigation, negligence claims, and employment lawsuits. 
  • Drafted appellate briefs and argued in the New York State Court of Appeals several novel legal issues in the areas of torts, negligence, and labor law. 
  • Served as Hearing Officer for more than a hundred student disciplinary matters
