Stephen D. Daly concentrates his practice on administrative and environmental litigation.  He has broad experience litigating environmental matters including toxic tort defense, defense against citizen suits, administrative appeals of agency permitting and enforcement actions, and cost recovery actions.  He also has experience litigating internal corporate disputes and contested mergers and acquisitions, many of which involved expedited litigation or motions for preliminary injunctions.

Steve is originally from Rochester, New York, and he recently relocated from Philadelphia to Buffalo to be closer to family.

  • Obtained summary judgment in favor of international pipeline company in defense against citizen suit brought under the federal Clean Water Act.
  • Obtained dismissal of a putative class-action lawsuit in favor of an international plastics manufacturer in toxic-tort lawsuit relating to a warehouse fire.
  • Successfully defended major energy infrastructure project in administrative hearing before the Delaware River Basin Commission and in other judicial proceedings against third-party challenges.
  • Defended issuance of a permit for a landfill expansion against a third-party challenge in an administrative appeal.
  • Defended issuance of a permit to expand a refinery’s operations against a third-party challenge in an administrative appeal.
  • Defended real-estate owner against cost-recovery lawsuit relating to historical environmental contamination.
  • Negotiated with EPA and responded to CERCLA section 104(e) information requests on behalf of international conglomerate relating to site in Puerto Rico.
